Governing Law: Republic of India (Indian Contract Act 1872, DPDP Act 2023)
This Terms of Service and Clinical Usage Agreement ("Terms") is a binding legal contract between you ("User", "you", or "your") and Noor Technologies ("Operating Entity", "DawaSnap AI", "we", "us", or "our"). By accessing our website, creating an account, or installing the mobile application (Android Package: in.dawasnap.app), you unconditionally agree to these Terms.
MANDATORY CLINICAL & MEDICAL DISCLAIMER:
1. NOT A CERTIFIED MEDICAL DEVICE: DAWASNAP AI IS AN INFORMATIONAL MEDICATION TRACKER AND CLINICAL REFERENCE TOOL. IT IS NOT A CERTIFIED MEDICAL DEVICE, DIAGNOSTIC SOFTWARE, CLINICAL DECISION SUPPORT SYSTEM, OR PRESCRIPTION DISPENSING PLATFORM.
2. NO DOCTOR-PATIENT RELATIONSHIP: No doctor-patient or healthcare provider relationship is created. All outputs from Dr. DawaSnap, packaging scanners, and interaction screeners are automated reference information only.
3. ALWAYS CONSULT A DOCTOR: Never start, change, pause, or discontinue any prescribed medication based on information in the application. Always consult your licensed physician, clinical pharmacist, or primary healthcare professional.
4. PACKAGING VERIFICATION: Optical character recognition (OCR) and camera scanners may occasionally misread reflective foil, damaged labels, or blurry text. You maintain sole responsibility to visually verify all medication names, dosages, and expiration dates against the physical pharmaceutical package before consumption.
5. DATA SOURCES: Drug reference monographs, safety warnings, and dosage parameters are compiled from public pharmacopeias including the Indian Pharmacopoeia (IP), CDSCO, and US FDA National Drug Code directory.
6. ACUTE MEDICAL EMERGENCIES: DawaSnap AI does not handle emergency triage. In case of suspected overdose, severe allergic reaction, or acute medical emergency, immediately contact local emergency services (112 / 108 in India, 911 in USA/Canada, 999 in UK).
2. Artificial Intelligence & Clinical Companion Architecture
DawaSnap AI employs a dual-mode clinical assistance architecture:
- Cloud AI (Google Gemini API): For online queries and multi-drug interaction analysis, queries are transmitted over encrypted TLS channels to Google Gemini. Personal identifiers (name, email, UID) are not attached to consultation queries.
- On-Device Offline Reference Engine: For offline consultation and fast lookup, the application embeds an offline, rule-based drug reference engine and heuristic packaging classifier running entirely within local device memory. User queries and medication lists are never transmitted to external servers when using the offline engine.
- Zero Model Training: Your private medication records and consultation chats are never used to train or refine artificial intelligence models.
- Probabilistic Nature: AI outputs are probabilistic and may contain inaccuracies. You agree to treat all AI outputs as supplementary reference material and not clinical directives. Users can report inaccuracies via the in-app "Report" button.
3. Hardware Permissions & Notification Delivery
- Push & Local Notifications (POST_NOTIFICATIONS): Used solely for scheduled dose reminders and expiration warnings. DawaSnap AI does not request restricted exact alarm permissions (
SCHEDULE_EXACT_ALARM). Notifications are scheduled via standard local channels and Firebase Cloud Messaging without commercial marketing or advertisements. - Camera & Local Storage: The camera is used solely to photograph medicine labels. Packaging photos are stored locally in your device's sandboxed IndexedDB storage (
DawaSnapLocalImages) and are never written to Firestore database documents.
4. User Eligibility & Prohibitions
You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to use DawaSnap AI independently. Minors aged 13 to 17 may use the service only under active parental or legal guardian supervision. Children under 13 are strictly prohibited from creating accounts.
You agree NOT to:
- Reverse engineer, scrape, or extract proprietary databases or code from the application.
- Use DawaSnap AI for unlicensed telemedicine, prescription counterfeiting, or unlawful pharmaceutical distribution.
- Circumvent security controls, authentication tokens, rate limits, or Firebase Firestore security rules.
5. Intellectual Property & Data Ownership
All software code, brand assets, doctor logos, heuristics, and offline formulary databases are the exclusive intellectual property of Noor Technologies (MD Hassan). You retain full ownership of your personal medication records and health logs.
You may permanently delete your account and all associated cloud and local data at any time via in-app Settings or through our dedicated web portal: https://dawasnap.vercel.app/delete-account.
6. Disclaimer of Warranties ("AS IS")
DAWASNAP AI AND ALL ASSOCIATED SERVICES, APIS, ON-DEVICE OCR, AND AI PHARMACIST FEATURES ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, OR STATUTORY.
WE EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, CLINICAL ACCURACY, FREEDOM FROM DEFECTS, OR FREEDOM FROM NOTIFICATION LATENCY CAUSED BY DEVICE OPERATING SYSTEM BATTERY-OPTIMIZATION MODES.
7. Limitation of Liability
To the fullest extent permitted by applicable law, neither Noor Technologies nor its contributors shall be liable for any personal injury, adverse drug event, allergic shock, missed dose, toxicity, death, or indirect damages resulting from your use of or reliance upon the application.
8. Governing Law, Jurisdiction & Class Action Waiver
- Governing Law: This Agreement shall be governed by and construed in accordance with the substantive laws of the Republic of India (including the Indian Contract Act, 1872 and the Digital Personal Data Protection Act, 2023).
- Dispute Resolution: Any dispute arising hereunder shall be subject to the exclusive jurisdiction of the competent civil courts located in India.
- Informal Resolution: Prior to filing any legal claim, you agree to contact
newluckypharmacy@gmail.comto attempt good-faith informal resolution for 30 calendar days. - Class Action Waiver: All disputes must be resolved on an individual basis. You waive any right to bring or participate in any class action or collective proceeding.
